If a settlement is reached at the mediation, it is important that the parties memorialize the settlement before concluding the session. It is strongly recommended that prior to the mediation, the parties exchange a template of either a memorandum of understanding that includes the key terms of the settlement or a long form settlement agreement, and attempt to work out any material disputes in advance of the mediation.
