In Naranjo v. Spectrum Security Services, Inc. (2022) 13 Cal.5th 93, the California Supreme Court ruled that employees can recover wage statement and waiting time penalties based on meal and rest break violations, in addition to the one-hour of pay owed for non-compliant breaks. Wage statement penalties can be awarded up to $100 per employee per pay period, and waiting time penalties can be as much as 30 days of pay.  The Court’s decision significantly raises the stakes for employers defending meal and rest break class actions.
